Bavinhost respects intellectual property rights and expects our users to do the same. We respond to valid notices under the Digital Millennium Copyright Act ("DMCA") and similar laws where applicable.
Reporting Copyright Infringement (DMCA Takedown)
If you believe content hosted on our network infringes your copyright, please send a written notice that includes:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it (e.g., URL).
- Your contact information (name, address, phone number, email).
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
Send DMCA notices to our designated agent: info@bavinhost.com or use our Report Abuse form and select "Copyright / DMCA". We may forward the notice to the account holder and/or remove or disable access to the material in accordance with the DMCA.
Counter-Notification
If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification that includes: (1) identification of the material that was removed or disabled and its location before removal, (2) your contact information, (3) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification, (4) consent to jurisdiction of the federal court in your district (or if outside the U.S., any judicial district in which we may be found), and (5) your physical or electronic signature. Send counter-notifications to the same address as above. We may forward the counter-notification to the original complainant. If the copyright owner does not file a court action, we may restore the material.
Repeat Infringers
We may terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
